Family Court Judge Doug Chamberlain says on Thursday the court received a letter of opportunity for hearing concerning the group home's license to operate.

Court officials now have 30 days to seek a hearing before the Ohio Department of Job and family Services.

State officials who inspected the group home in January found 43 violations, including failure to document behavioral intervention plans for residents. Last month the ODJFS rejected the court's plan to fix the problems and reopen.

Judge Chamberlain says it is likely the court will opt for a hearing to explain many of the violations...such as structural issues that were in place at the time of licensure in May 2005 and personnel files that were housed at the court instead of the facility.

Former resident Christopher Tindall was arrested in December in the fatal beating of Joan Green, who lived just two doors down from the home.

The 16-year old boy has pleaded not guilty to numerous adult charges, including aggravated murder and rape.

At this time the group home is not operating.
