On Friday night, police responded to a report of a dispute at Waffle House involving a male patron who displayed a firearm.
Witnesses stated that the individual got into a silver Dodge pickup truck and left the scene, heading southbound on North Main Street.
Officers quickly located the vehicle and noticed erratic driving, including swerving and fluctuating speed.
The truck made sudden movements and nearly struck the curb before entering a gas station parking lot.
Upon arrival, officers drew their weapons and ordered the male driver, later identified as Michael Atzbach, 43, of Kenton, to exit the vehicle.
Atzbach showed several signs of intoxication, including bloodshot eyes and slurred speech.
A handgun was found on the passenger seat, along with several unopened cans of alcohol.
Atzbach was arrested for operating a vehicle while impaired and improperly handling a firearm in a motor vehicle, a felony charge due to his intoxicated state.
He declined to perform field sobriety tests and refused a chemical test at the police station.
Witnesses at Waffle House reported that Atzbach had been disrespectful and, after displaying the handgun while smiling at patrons, was asked to leave.
The investigation remains ongoing, and the firearm, along with the vehicle, has been secured as evidence.
