Judge Kevin P. Braig of the Logan County Court of Common Pleas has sentenced Steve McMillen to 2.5 years in prison for having weapons while under disability, a third-degree felony.
The court also ordered that all firearms in McMillen’s possession be forfeited.
McMillen’s disability stems from a 2002 felony conviction for drug possession.
During sentencing, Judge Braig highlighted that McMillen’s weapons offense went beyond personal possession.
According to court documents, McMillen had 11 firearms laid out on a bed and mistook law enforcement at his door for a buyer.
Records show he sold firearms to other felons and had a long history of criminal convictions.
A presentence investigation report also noted that McMillen smelled of alcohol during his interview.
Prosecutor Eric Stewart and defense attorney Wesley Davis had jointly recommended a lengthy local jail sentence and probation instead of prison.
Judge Braig rejected that recommendation, emphasizing the seriousness of McMillen’s actions.
Assistant Prosecutor Erin Rosen represented the state during the hearing and informed the court of the joint recommendation.
“This is not a case of a convicted felon having a single firearm for personal protection,” Judge Braig said. “This is a case of convicted felon trading in firearms and selling firearms to other convicted felons. This is more serious than the normal having weapons under disability case.”
