An Urbana man is facing an operating a vehicle under the influence (OVI) charge after police investigating a report of an open alcohol container at the Walmart Tire Center allegedly found signs of impairment.
According to the Urbana Police Division, officers were dispatched around 11:30 a.m. on Sunday, July 19, to the Walmart Tire Center on East U.S. Route 36 after an employee reported an open container of alcohol inside a vehicle being serviced.
Police located a white 2012 GMC Terrain belonging to Martin Brown and observed an open 16-ounce Bud Light bottle in the center console cup holder. Officers also reported finding two empty Natural Light cans on the passenger-side floorboard.
Brown was located inside the store and told officers he had driven to Walmart for vehicle service after stopping at a drive-thru to purchase the Bud Light, according to the report.
While speaking with Brown, officers reported detecting a moderate odor of alcohol and noticing slurred speech. He was asked to perform standardized field sobriety tests, during which police said they observed several clues of impairment.
Brown later agreed to provide a portable breath test, which registered 0.162.
He was then arrested and transported to the Urbana Police Division, where he was advised of his rights and agreed to submit to an evidentiary breath test.
Police said Brown’s breath test showed a blood alcohol concentration of 0.14.
Brown was cited for operating a vehicle under the influence under Urbana City Ordinance and was later released to a sober driver.
