A 47-year-old Dublin man was charged with OVI and having an open container of alcohol following an incident at Walmart in Urbana late Sunday night, October 25.
According to an Urbana Police Division report, officers were dispatched to Walmart on East U.S. Route 36 around 11:31 p.m. after a report of a man who appeared intoxicated while sitting in a black SUV. The caller also reported seeing the driver take a shot of a clear liquid.
Officers located Norris Mitchell in a Chevrolet Equinox in the parking lot. According to the report, officers observed open containers of alcohol in the vehicle and noted a strong odor of an alcoholic beverage, along with bloodshot and glassy eyes.
Mitchell agreed to perform standardized field sobriety tests, during which the officer reported observing multiple indicators of impairment. A portable breath test showed a result of 0.215, and a subsequent breathalyzer test at the police department recorded a blood alcohol concentration of 0.188.
The report states officers recovered two vodka bottles, one empty and the other partially empty, along with a shot glass containing an alcoholic beverage.
Mitchell was charged with OVI, a first-degree misdemeanor, and open container, a minor misdemeanor.
According to the report, officers were later called back to Walmart after Mitchell returned to his vehicle and was found in the driver’s seat with the vehicle running. Officers arranged for his ride to return and pick him up.
