Smith arrested after passing out at Speedway, resisting officers

A Bellefontaine man was arrested early Friday morning after police say he was found passed out at Speedway and later resisted officers attempting to take him into custody.

According to a Bellefontaine Police Department report, officers were dispatched around 12:45 a.m. to the gas station on South Main Street after a caller reported a man lying across an outdoor table and appearing unconscious.

When officers arrived, they found the man seated at a table on the south side of the business with his upper body resting on the tabletop.

Police said his face was inside a pizza box containing leftover pizza, and an open can of Twisted Tea was sitting nearby.

Officers attempted for several minutes to wake the man by calling out to him, shining a flashlight in his direction, and shaking the table.

Police said the man eventually responded and was disoriented, struggled to open his eyes, and had difficulty speaking clearly.

According to the report, officers also smelled alcoholic beverages on the man’s breath.

When questioned, the man reportedly became agitated and denied drinking.

Police identified the man as 48-year-old Justin Smith.

Officers informed Smith that he was under arrest and ordered him to stand up and place his hands behind his back.

Police said Smith refused commands and had to be physically restrained.

During the arrest, officers reported that Smith continued to resist, yelled profanities, and struggled against officers as they attempted to search him and escort him to a cruiser.

Smith was transported to the Logan County Jail, where authorities say he continued to refuse commands and was eventually placed in a restraint chair.

According to the report, Smith initially refused to provide his name or date of birth and was later identified through prior interactions and booking photographs.

Smith was charged with public intoxication, obstructing official business, and resisting arrest.
